1. About these terms
These terms apply to the quotations we issue and the joinery and cabinet-making services we provide. By accepting a quotation in writing you agree to these terms. If anything is unclear, please ask before signing.
2. About us
Bespoke Joinery Lothian is a bespoke joinery and cabinet-making business based in Edinburgh, serving clients across Edinburgh and the Lothians.
3. Quotes and estimates
Quotations are free and based on the information available at the time of survey. Unless stated otherwise, quotes are valid for 30 days and are not binding until accepted by you in writing (including by email) and confirmed by us.
4. Contract formation
A contract is formed when you accept our written quotation and we confirm acceptance, or when both parties sign a written work order. The contract incorporates the scope, drawings, specifications, and price set out in that document together with these terms.
5. Deposits and payment
Unless otherwise agreed in writing, a deposit is payable on acceptance of the quotation to secure materials and start dates. The balance is due in accordance with the payment schedule set out in the quotation. Late payment may result in suspension of work and may incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.
6. Variations
Changes to scope, design, materials, or finishes after the contract is formed will be priced separately and require your written agreement before we proceed. Variations may affect the programme and completion date.
7. Site access and client responsibilities
- You will provide safe access to the property during agreed working hours.
- You will provide reasonable access to electricity, water, and welfare facilities where required for the work.
- You will move or protect fragile items in the working area.
- You will obtain any landlord, tenement, or planning permissions needed before work begins.
8. Workmanship and warranty
We warrant that our work will be carried out with reasonable skill and care and will be free from defects in workmanship for a period of 12 months from completion. The warranty does not cover fair wear and tear, damage caused by misuse, alterations made by others, or movement of the underlying building structure. This warranty is in addition to your statutory rights as a consumer.
9. Liability
Our total liability under or in connection with the contract is limited to the price paid for the work. We exclude liability for indirect or consequential loss. Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
10. Cancellation
Where the contract is concluded away from our business premises, you may have a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to start work within that period and then cancel, we may charge for work and materials supplied to the point of cancellation. Bespoke items already in production may not be refundable.
11. Intellectual property
All drawings, designs, and project photographs produced by us remain our property. We may use photographs of completed work for portfolio and marketing purposes unless you tell us in writing that you would prefer we did not.
12. Governing law and jurisdiction
These terms and any dispute arising out of them are governed by Scots law. The Scottish courts have exclusive jurisdiction to settle any dispute, except that nothing prevents you from bringing proceedings in another part of the United Kingdom where the law allows.
